Key takeaways

  • Rhode Island hemp licensees can now quarantine hemp-derived products over 0.4 mg total THC per container instead of clearing them out before Dec. 11, 2026.

  • Products going into quarantine must be listed on the CCC's Hemp Quarantine 2026 document by Dec. 4, 2026.

  • Quarantined stock can't be processed, moved, distributed or sold, and the list is frozen after Dec. 11.

  • Over-limit hemp products can't be transferred to cannabis retailers or sold as cannabis.

Rhode Island hemp businesses facing the federal THC limit just got a third option besides selling out or destroying stock: they can lock it away. The change gives growers and brands room to wait and see whether Congress moves the line again, but it doesn't let them sell anything.

The Cannabis Control Commission (CCC) amended Cannabis Office Bulletin 2026-7 on Oct. 8, 2026. Rhode Island Current reports the commission emailed the policy to all 201 of the state's hemp licensees on Oct. 9.

What the Rhode Island hemp quarantine rule changed

The bulletin first went out on Sept. 11. That version said every hemp-derived product over the federal limit had to be removed from licensed facilities before Dec. 11, the date Section 781 of the Continuing Appropriations and Extensions Act of 2026 caps hemp products at 0.4 mg of total THC per container.

The amended version keeps the Dec. 11 limit but lets licensees store over-limit products in a designated quarantine area at their licensed facility. Only products made, processed or bought in compliance with the rules before Dec. 11 qualify, and nothing else can share that space.

"They are not permitted to be further processed, moved, distributed and/or be offered for sale unless explicitly authorized by the Federal Government and/or the Cannabis Control Commission."

CCC spokesperson Charon Rose told Rhode Island Current that regulators updated the guidance so businesses wouldn't be forced to destroy inventory while it's still uncertain whether Congress will change course.

Rules for quarantined hemp inventory

  • Destruction stays possible. You can ask the Cannabis Office to destroy quarantined products at any time, but destruction must happen under its supervision.

  • Make it unusable first. The FAQ says to grind hemp waste into other non-consumable waste so the mix is at least 50% non-cannabis by volume, then take it to a licensed solid waste facility.

  • Expect audits. The Cannabis Office may inspect quarantine areas and audit inventory at any point.

  • No cannabis-side exit. Over-limit hemp products can't move to a licensed cannabis retailer through an External Transfer, whatever testing method was used before.

What hasn't changed for hemp growers

The bulletin says the new limit doesn't affect planting, growing, sampling, harvesting or required testing. Growers still need a CCC license, and products under 0.4 mg still require a license and must follow the state hemp rules in 560-RICR-10-20-1.

That gap frustrates some growers. Mike Simpson of Lovewell Farms told Rhode Island Current the state lets him grow but not sell, and that "it really makes no sense."

What this means for operators

  1. Count your over-limit stock now. Sort inventory by total THC per container, not delta-9 alone, so you know what goes into quarantine.

  2. File the Hemp Quarantine 2026 document by Dec. 4. Anything not listed can't be held after Dec. 11. Keep a copy on site.

  3. Set up a physically separate quarantine area. Only qualifying pre-Dec. 11 products can be stored there.

  4. Pull listings by Dec. 11. Over-limit products can't be shown or advertised on your website after that date.

  5. Decide what to destroy. If you won't hold a product, schedule supervised destruction through [email protected].

  6. Ask before you restart. Licensees have asked whether resuming sales after a federal change would need separate CCC approval. Get that answer in writing.

What this means for cannabis workers

If you handle hemp inventory, expect a busy few weeks of counting stock and moving products into a quarantine area. Once that list is filed, those items shouldn't be touched without approval.

Retail and e-commerce staff should plan to take over-limit products off shelves and websites before Dec. 11.

The bigger picture

States are handling the federal line differently. Illinois will treat hemp over 0.4 mg as cannabis that only dispensaries can sell, while Rhode Island bars that route entirely. Rhode Island Current reports the state's hemp industry generated $2.85 million in sales in 2025.
