Missouri AG Catherine Hanaway sued four “hemp dispensaries” on Nov. 4, 2026: Puffers Choice (Aurora), CBD Kratom Cannabis Dispensary (Des Peres), Herb Depot (Independence) and Token THC Dispensary (Rock Port).
The same day, the U.S. District Court for the Western District of Missouri dismissed a hemp-industry challenge to House Bill 2641.
Key HB 2641 rules take effect Nov. 12, 2026: 0.3% total THC including THCA, 0.4 mg THC per finished hemp container, and intoxicating products only through licensed marijuana retailers.
Hanaway told the Missouri Independent “You’re going to see more lawsuits” once the stronger tools kick in.
Missouri’s crackdown on intoxicating hemp products is no longer waiting for the calendar. Attorney General Catherine Hanaway filed four lawsuits against retailers she says sold marijuana while posing as hemp shops, and a federal judge cleared another roadblock to House Bill 2641 the same day.
In a Nov. 4, 2026 press release, Hanaway’s office said the retailers marketed products as federally legal hemp while selling goods that exceeded legal THC limits and presented themselves like licensed dispensaries. Key HB 2641 provisions take effect Nov. 12, 2026.
Who Missouri sued
Business | City |
|---|---|
Puffers Choice LLC | Aurora |
CBD Kratom Cannabis Dispensary (MNG 2005 Inc.) | Des Peres |
Herb Depot (Thooli LLC) | Independence |
Token THC Dispensary (Token Hemp Company, LLC) | Rock Port |
The AG is seeking civil penalties and injunctive relief. In the Puffers Choice, CBD Kratom and Herb Depot cases, the office is also seeking to designate the businesses as statutory drug-den public nuisances.
Des Peres undercover buys and lab results
The first amended petition against CBD Kratom Cannabis Dispensary describes undercover purchases on or about Oct. 8, 2026, of two “hemp flower” products — Blueberry x Lemon Bars and Sour Cherry Gelato — sent to a state-licensed lab.
Blueberry x Lemon Bars packaging listed 0.28% delta-9 THC on a dry weight basis. Lab results cited in the petition put it at more than 10 times the legal hemp maximum; the Missouri Independent reported that lab figure as about 4%. Sour Cherry Gelato packaging listed CBD and THCA without disclosing delta-9, while lab testing found delta-9 above 0.3%.
"The days of “hemp shops” masquerading as legal marijuana dispensaries are over in Missouri."
HB 2641 takes effect Nov. 12, 2026
Under HB 2641, products with more than 0.3% total THC — including THCA — generally fall outside Missouri’s hemp definition. Finished hemp-derived cannabinoid products face a 0.4 mg THC-per-container limit. Intoxicating products covered by the new rules can be sold only through licensed marijuana retailers.
Also on Nov. 4, the Western District of Missouri dismissed a challenge to the law. The AG said the court rejected federal-preemption and constitutional claims. Judge M. Douglas Harpool’s order, as reported by the Independent, found the law had not yet taken effect and its application to the plaintiffs remained uncertain. Plaintiffs included the Missouri Hemp Trade Association, MNG 2005 Inc. and Lifted Liquids Inc.
What this means for operators
Audit inventory before Nov. 12. Anything over 0.3% total THC including THCA, or over 0.4 mg THC per finished container, belongs in the licensed marijuana channel — or off the floor.
Drop “dispensary” branding if you are not licensed. The petitions treat that mimicry as a consumer-protection problem.
Check COAs against labels. The Des Peres example is label-versus-lab under existing law, not only the new statute.
Expect more AG cases. Hanaway told the Missouri Independent, “You’re going to see more lawsuits,” with stronger tools after Nov. 12.
What this means for cannabis workers
Licensed dispensary staff keep the same SOPs and agent rules. If you work in a hemp or smoke-shop role that sells intoxicating cannabinoids, ask in writing what leaves the shelf by Nov. 12 and how total-THC and per-container limits will be checked. Do not assume “hemp flower” branding keeps a product legal.
The bigger picture
Missouri’s Nov. 12 date lines up with similar total-THC shifts in other states and the approaching federal hemp redefinition timeline. Operators who already track total THC and THCA are better positioned than shops that leaned on delta-9-only labels.
